Question by jammin7000: Can a California GENERAL partnership file bankruptcy without using an attorney?
I know of a company, and probably a limited partnership requires a lawyer to file BK in California, but a 100% general partnership, have a lawyer as well as rent or it can go “in pro per”? Thank you!

No, unless the only partners are a husband and wife who are filing a joint consumer bankruptcy AND they are able to accommodate all the business debts and assets within the structure of a consumer bankruptcy in which – necessarily – the debts must be “primarily” consumer (not business) debts (note: this can be tricky unless it is a very small business).

In any other situation (and also sometimes when the only partners are husband and wife) you will need to file a business bankruptcy in which (by law) the business filing the bankruptcy must be represented by an attorney.
